That could be an artifact of 'patch' - which one are you using?
Since those were new files, they appear in the patch as

The /dev/null may confuse some older versions of patch -- they may work
if an explicit zero-length file were referenced. (I generate all of my
patches the same way, so this wouldn't be a new problem).
